条文は次の通り。

第四章 国会

第五十七条 両議院の会議は、公開とする。但し、出席議員の三分の二以上の多数で議決したときは、秘密会を開くことができる。

(2) 両議院は、各々その会議の記録を保存し、秘密会の記録の中で特に秘密を要すると認められるもの以外は、これを公表し、且つ一般に頒布しなければならない。

(3) 出席議員の五分の一以上の要求があれば、各議員の表決は、これを会議録に記載しなければならない。

CHAPTER IV. THE DIET

Article 57.

1. Deliberation in each House shall be public. However, a secret meeting may be held where a majority of two-thirds or more of those members present passes a resolution therefor.

2. Each House shall keep a record of proceedings. This record shall be published and given general circulation, excepting such parts of proceedings of secret session as may be deemed to require secrecy.

3. Upon demand of one-fifth or more of the members present, votes of the members on any matter shall be recorded in the minutes.

考え方

この条文は、国会は原則として公開する旨が規定される。但し、秘密会にすることも可能で、その条件は出席議員の2/3以上の賛成である旨が規定される。

また、国会は議事録を保存する必要があり、秘密会などで公開できないもの以外は公開せねばならない。

Article LIII.

The deliberations of the Diet shall be public, and no secret sessions shall be held. The Diet shall maintain and publish a record of its proceedings and this record shall be made available to the public. The individual votes of members on any question shall be recorded in the journal upon the demand of twenty per cent of those present.
